Theranos founder Elizabeth Holmes lost her retrial bid. Her sentencing is now set for Nov. 18.


Elizabeth Holmes' request for a new trial was denied Monday.

Ten months after a jury convicted Holmes on four separate fraud charges, U.S. District Judge Edward Davila ruled against the Theranos founder. It's unlikely that a new trial would result in Holmes' acquittal, because her lawyers haven't introduced material new evidence nor established government misconduct, Davila said. The judge had previously denied her request for an acquittal.
