Embattled Oakland businessman Tom Henderson was indicted by a federal grand jury for his alleged role in a $110 million investor fraud scheme involving federal EB-5 visas and arrested Tuesday morning.

The U.S. Attorney’s Office for the Northern District of California charged Henderson, 70, and two associates, 40-year-old Kexing Hu (also known as Peter Hu) and 42-year-old Cooper Lee, with several counts of conspiracy and wire fraud.

Cohen-Esrey LLC, an Overland Park-based real estate company, plans to move its headquarters down the road to Merriam.

The company, whose areas of service include real estate investment, development, acquisition and management, mostly in the affordable multifamily sector, bought the Merriam Oaks Building at 8500 Shawnee Mission Parkway.
